California Privacy Notice

Introduction
This California Privacy Notice supplements our Privacy Policy and is designed to notify California residents of the personal information about them we may collect, use and disclose and includes information on how California residents can exercise their rights under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA) (collectively, the “California Privacy Laws”).
If you are a resident of California, this California Privacy Notice (this “Notice”), together with our User Privacy Policy, applies to you. However, this Notice does not apply to the personal information we collect from California residents who are employees or job applicants, owners, directors, or officers of Classic Performance Products, Inc. (the “Company”). If you are an employee or job applicant, please contact us for our Employee Privacy Policy.
We may update this Notice from time to time. If we make changes, we will notify you by revising the Effective Date above and, in some cases, we may provide you with more prominent notice (for example, by adding a statement to our homepage or sending you a notification), such as in connection with making material changes to this Notice. We encourage you to review this Notice regularly to stay informed about our information practices and the choices available to you.
Collection, Use and Disclosure of Personal Information
1. Categories of personal information we may collect
During the 12-month period prior to the effective date of this Notice, we may have collective the following categories of personal information, including sensitive personal information, about you:
- Identifiers, including information that identifies you, such as your real name, alias (such as your username), postal address, email address, telephone numbers, driver’s license number, passport, bank account number, credit card and debit card numbers and other financial account information, log-in information, and contents of communications between users of our blogs.
Sensory Information, including audio and visual information. - Commercial Information, including records of personal property, products or services purchased, obtained or considered, and other purchasing or consuming histories.
- Internet or other electronic network activity information, including computer and connection information, such as statistics regarding your use of our Services, information on data traffic to and from websites, referral URL, information on advertisements, your IP address, your access times including accessed pages within our Services, your language settings, and your weblog information, model or device type, operating system and version, browser type and settings, device identifier, and cookie-related data.
- Geolocation information, including your general location data (e.g., IP address) and the precise location data of your mobile device when enabled (unless you disable the use of precise location services for all applications in the settings menu of your mobile device).

2. Categories of sources of personal information that we collect
We receive personal information about you from a variety of sources, including directly from you, your devices, and from our business partners. The categories of sources from which personal information is collected includes:

3. Business or commercial purpose for collection and use
- We collect personal information about you for various business or commercial purposes, including:
- To perform and improve our services, including those you have purchased from us or our dealers, maintaining or servicing accounts (e.g., your My Account), providing customer service, administering our blogs or forums,
- Processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, or providing similar services
- Administering and fulfilling contests, sweepstakes and other promotions and deliver rewards
- Displaying advertisements intended for you based on your activities over time and across nonaffiliated websites or online applications, used to predict your preferences or interests
- Detecting and responding to security incidents or protect against deceptive or illegal activity.
- Customizing your experience
- Complying with and enforcing applicable law and our policies

b. We may sell or share personal information about you for cross-context behavioral advertising, which means we or others may place digital ads to you based, at least in part, on personal information obtained from your activity on our or others’ digital properties.
c. We do not “sell” personal information in the traditional sense (e.g., to exchange for money personal information to data brokers or third parties for their independent advertising), but we may have sold or shared (as defined by CA Privacy Laws) online Identifiers (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology) associated with a device used to interact with our digital properties or advertisements. In addition, we may have sold by virtue of receiving in exchange “other valuable consideration” the following categories of personal information to the following recipients, and why.

d. We do not sell the personal information of consumers under the age of 16 if we have actual knowledge of the person’s age.
Data Retention
The time we retain personal information varies depending on our services, the nature of the personal information and our legal obligations under applicable law. The following factors typically affect the retention period:
- Necessity for the provision of our Services
- The amount, nature and sensitivity of the personal data
- The potential risk of harm from unauthorized use or disclosure of your personal information
- The purposes for which we process your personal information
- The applicable legal requirements
Children
We do not knowingly collect, disclose, or sell the personal information of consumers under the age of 16 if we have actual knowledge of such person’s age. According to our Terms of Use Agreement, children under the age of 18 are not permitted to use our Services. If you are a parent or guardian and become aware that your child has provided us with personal information, please contact us and we will work with you to address the issue.
Your Privacy Rights
The California Privacy Laws provide various rights to California residents. These include rights to access, deletion, correction, opt-out, and non-discrimination. This section provides more information about each right and how consumers can exercise these rights. If you choose to exercise any of your rights, you have the right not to receive, and will not receive, discriminatory treatment by us. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.
Employees are provided notice via different statement.
1. Individual Rights.
Right to Know. California consumers have the right to request that we disclose the personal information that we collect, use, disclose, and sell. This includes the right to request (i) the categories of personal information collected, sold or shared, (ii) the categories of sources of personal information collected, (iii) the categories of third parties to whom the information is sold or shared, (iv) the business or commercial purpose for collecting or sharing personal information, and (v) the specific pieces of personal information we have collected.
We try to fulfill Right to Know requests within 45 days of receiving the verifiable request. If we need more time or additional information to fulfill your request, we will write to let you know. This information will be provided to you free of charge, unless we determine that your request is manifestly unfounded or excessive in which event we may charge you a reasonable fee to honor your request or decline to honor your request. You may request this information twice in a 12-month period. There are certain exceptions to a consumer’s Right to Know. We will state in our response if an exception applies.
Right to Delete. Subject to some exceptions, California consumers have the right to request the deletion of the personal information we have collected from them. Deletion requests may take 45 days to fulfill. If we need more time or additional information to fulfill your request, we will write to let you know.
Right to Correct. Subject to some exceptions, California consumers have the right to request the correction of any inaccurate personal information we maintain about them. Corrections made to your Company profile will be made immediately. Correction requests submitted through a webform may take up to 45 days to fulfill. If we need more time or additional information to fulfill your request, we will write to let you know.
Right to Opt-Out of Sale. You have the right to opt-out of the Sale of your personal information. “Sale” is defined broadly under California Privacy Laws to include practices common among online marketplaces. Please note that opt-out choices may be stored via cookies. If you clear cookies, or if your browser blocks cookies, or if you view the page from a different browser or device, your opt-out choice may no longer be logged or recognized.
Right to Opt-Out of Sharing. You have the right to opt-out of the sharing of your personal information if we share personal information for cross-context behavioral advertising purposes.
Right to Opt-Out of Marketing Communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
Right to Limit the Use and Disclosure of Sensitive Personal Information. If we process sensitive personal information (as that term is defined under California Privacy Laws), we will only do so for the purposes specifically authorized by California law and in a manner that is necessary and proportionate for those purposes. As such, we do not perform any processing for which a Right to Limit request is available. Review/confirm per CA Civ Code 1798.121(a) and 1798.140(e)(2, 4, 5 and 8)
Right to Non-Discrimination. You have the right not to be discriminated against for exercising any of the rights described in this section. The Company will not discriminate against you for exercising or requesting to exercise your privacy rights noted above.
2. How to Exercise California Privacy Rights.
Submitting Requests. You can submit your request to know, delete or correct by submitting a “Privacy Rights Request” by clicking here or by toll-free phone at 1 (800) 522-5004 and leave a detailed message including your first and last name, date of birth, email address and zip code, along with instructions for the correction. Please provide the information associated with your account or that you use to transact with the Company. You must provide all required information to submit a request. Only complete requests received by and Compliance Officer that include all required information and that are matched with information in our records will be processed. For your safety and security, we may ask you for more information where required to verify your identity. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one set out in this policy.
Verifying Requests. To ensure the protection of your personal information and for the Company to fulfill your request to exercise these rights, we must verify that the individual submitting a request to know, delete or correct is the consumer to whom the requests relates prior to processing the request and you must provide sufficient personal information (including your name, date of birth, email address and zip code) for us to reasonably verify that you are the consumer from whom we collected the personal information. In some cases, to process your request, you may be required to provide a separate proof of identity and proof of address. We may also request that you sign a declaration under the penalty of perjury from the consumer whose Personal Information is the subject of the request. The information you send us to verify your identity will be used solely for the purpose of identity verification related to the request made. If we are unable to verify your identity or if we suspect fraudulent activity, we may decline to comply with your request. You do not need to create an account with us to make a Privacy Rights Request.
Authorized Agents. You may choose a person or a business registered with the California Secretary of State that you authorize to act on your behalf to submit your requests. If you choose to use an Authorized Agent, we require that you provide the Authorized Agent with written permission to allow them to submit your request and that you verify your identity directly with us. Failure to do so may result in the Company denying your request.
To exercise your Right to Opt-out of Sale, please visit Cookie Manager and toggle Do Not Sell My Personal Information to Active. Please note that the Company is unable to permanently opt-out consumers who do not have a registered account. When non-registered users opt-out by clicking the above link and setting the toggle switch to “Active,” the opt-out choice will only apply to your use of the Website through the browser used to submit the opt-out request so long as that browser’s cookies are not erased.
3. California’s “Shine the Light” Law
If you are a California resident, you are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of Personal Information to third parties for their direct marketing purposes in the preceding calendar year. The Company does not share personal information with third parties for their own direct marketing purposes without obtaining your consent or providing the ability to opt-out.

1. Cookies.
We encourage you to manage your browser-based cookies by adjusting your device browser settings (e.g., Chrome, Edge, Firefox, Internet Explorer, or Safari). For more detailed information about our practices related to cookies and similar technologies, please see visit our Cookie Manager.
2. Do Not Track.
California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently isn't an industry or legal standard for recognizing or honoring DNT signals, we don't respond to them at this time.
